General Terms and Conditions of Sale

1. Purpose

These General Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) govern the contractual relationship between Velandre, operated by Maxime Silvestre (hereinafter the “Seller”), and any person making a purchase on the website velandre.com (hereinafter the “Customer”).

Any order placed on the Site implies full, complete, and unconditional acceptance of these Terms and Conditions. The Customer declares that they have read them before validating their order. The applicable Terms and Conditions are those in force on the date the order is placed.

3. Products

The products offered for sale are those appearing on the Site on the day the Customer visits it, subject to availability.

Each product is accompanied by a description prepared with the utmost care. The photographs and visuals illustrating the products are as faithful as possible but are not contractually binding; slight variations (colors, textures, on-screen appearance) may exist without giving rise to any liability on the part of the Seller.

If a product becomes unavailable after the order has been placed, the Customer will be informed as soon as possible and may choose either to opt for an equivalent product or receive a refund of the corresponding amount.

4. Prices

Product prices are indicated in euros (€), including all taxes (VAT included), excluding any applicable delivery costs.

As delivery is free, no shipping costs are added to the order amount for the areas served. For deliveries outside the European Union (Switzerland, Canada), customs duties or import taxes may apply and remain the sole responsibility of the Customer.

The Seller reserves the right to modify its prices at any time. However, products are invoiced based on the prices in effect at the time the order is validated.

5. Order

The Customer places an order by selecting the desired products, adding them to their cart, and then validating their order after checking its contents.

The order is definitively registered only after payment has been confirmed. A confirmation email summarizing the order details is then sent to the Customer. The sale is deemed concluded on the date this confirmation is sent.

The Seller reserves the right to refuse or cancel any order placed by a Customer with whom a dispute exists, or in the event of an abnormal, fraudulent, or bad-faith order.

6. Payment Methods

Payment is made online and securely. The Seller accepts the following payment methods:

Payment is charged at the time the order is validated. The order is processed only after effective confirmation of payment.

7. Payment Security

Transactions carried out on the Site are secured using the payment solutions provided by our service providers. Payment data is transmitted in encrypted form and is never stored by the Seller.

The Seller reserves the right to suspend or cancel any order in the event of non-payment, irregular payment, or fraudulent payment.

8. Delivery

Products are delivered to the delivery address provided by the Customer when placing the order. The delivery methods, times, areas, and conditions are detailed in our Shipping Policy, which forms an integral part of these Terms and Conditions.

9. Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to provide any reason.

The procedures for exercising this right, as well as the return and refund conditions, are specified in our Return and Refund Policy, which forms an integral part of these Terms and Conditions.

10. Legal Guarantees

Regardless of any commercial warranty, the Seller remains bound by the following legal guarantees:

  • the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code), which allows the Customer to obtain the repair, replacement, or refund of a non-conforming product within a period of two (2) years from its delivery;

  • the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), which allows the Customer to obtain a refund or a reduction in the price of a product affected by a hidden defect that renders it unfit for the purpose for which it is intended.

11. Liability

The Seller cannot be held liable for failure to perform or improper performance of the contract in the event of force majeure, an act or omission by the Customer, or an unforeseeable and unavoidable act by a third party unrelated to the provision of the services.

Likewise, the Seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, external intrusions, or the presence of computer viruses.

12. Personal Data

Personal data collected in connection with an order is necessary for its processing and is handled in accordance with the General Data Protection Regulation (GDPR). The procedures are detailed in our Privacy Policy.

14. Mediation and Dispute Resolution

In accordance with Articles L611-1 et seq. of the French Consumer Code, consumer Customers have the right to use a consumer mediator free of charge in order to seek an amicable resolution to a dispute with the Seller, provided that they have first submitted a written complaint to the Seller.

The Customer may also use the European Online Dispute Resolution (ODR) platform available at the following address: https://ec.europa.eu/consumers/odr.

15. Applicable Law and Competent Jurisdiction

These Terms and Conditions are governed by French law.

In the event of a dispute, and in the absence of an amicable resolution, the French courts shall have exclusive jurisdiction.

16. Acceptance and Enforceability

By validating an order, the Customer accepts these Terms and Conditions in full and without reservation. These Terms and Conditions take precedence over any other document, unless otherwise expressly and previously agreed to in writing by the Seller.
